At TrailPeak, we recognize the importance of our customers’ personally identifiable information or data (collectively referred to herein as “personal information”) and privacy. TrailPeak uses your personal information mainly to improve our products, services, and advertising. This TrailPeak Privacy Policy (the “Privacy Policy”) describes how TrailPeak and its parent, subsidiary, and affiliate companies (collectively “TrailPeak”, “we”, or “us”) collect, use, share, and store information through the mail, retail stores and wholesale accounts, trail-peak.com and other websites that link to this Privacy Policy (collectively the “Services”).

By visiting any TrailPeak Website (the “Websites”) or App, and/or by using the Services, including but not limited to, creating a TrailPeak account, purchasing and/or registering a product, downloading materials, registering for newsletters or updates, participating in an online survey, accessing customer care or warranty services, or by otherwise providing any personal information or data to TrailPeak, you agree to the policies described in this Privacy Policy and to TrailPeak’s Terms & Conditions of Use (the “Terms”) at www.trail-peak.com/terms-and-conditions, which are incorporated into this Privacy Policy by this reference. If you are a California resident, the California Consumer Privacy Act (“CCPA”) provides you with additional rights as described in the section below entitled “Additional Privacy Rights for California Residents”.

Each time you visit any TrailPeak Website or App, or use our products or Services, you consent to the use of your information as described in this Privacy Policy, so please review this Privacy Policy and contact us if you have any questions. This online Privacy Policy applies only to information collected online and not to information collected offline. TrailPeak is not responsible for the privacy practices of any third parties.

Personal Information

Throughout this Privacy Policy, “personal information” means information that can be used to directly or indirectly identify you, your household, or device. The term “personal information” does not include (a) publicly available information, including from government records; (b) anonymous, deidentified, or aggregated consumer information; and (c) any other information excluded from any applicable state or federal law, including but not limited to the CCPA.

Information We Collect

We typically collect personal information when you purchase our products or Services, use or register with our Websites and/or App, enter into a sales promotion or a campaign, or otherwise interact with us online. When you access the Websites or App, use our Services, or otherwise provide any personal information to us, we may collect, use, and store that personal information, including but not limited to your name, mailing, shipping and billing address, contact preferences, and credit card information, as well as your interactions, browsing and search history. We may also collect information that you provide to us about other people, for example, by purchasing gifts or products for family or friends, we may collect their name, mailing address, and email address. We may also collect your Internet Protocol (“IP”) address (which is the number automatically assigned to your computer whenever you access the Internet), browser type and language, Internet service provider (“ISP”), referring and exit pages, operating system, date and time stamp, and other data. The IP address does not identify your name, email address, or other personal information, other than the IP of your device.

We also collect non-personal information, i.e., information that is not associated with a specific individual, from you when you visit the Websites, App, and/or use our Services.

Use of Personal Information We Collect

The personal information we collect allows us and our marketing provider(s) to keep you posted on TrailPeak’s latest product announcements, updates, upcoming events, and TrailPeak news, and helps us to improve our products, Services, content, and advertising. We use the personal information that you provide us to process your order, verify, bill, and collect payment for products that you order. We may use your contact information from any order to send TrailPeak products, catalogs, emails, and other information about TrailPeak, its affiliates, and/or its partners. If you register for TrailPeak’s newsletter or mailing list and provide your email address to us, we will send you emails or other communications that may inform you of new products, special sales, promotional offers from TrailPeak, our affiliates, partners, TrailPeak news, and any other events or issues that we think you may enjoy or find interesting. We may use your IP address to help diagnose problems with our server, to administer our Websites, understand and analyze trends, learn about user behavior on the site, and to gather demographic information about our user base as a whole. Any of the information we collect from you may be used in a variety of ways, including but not limited to the following: to personalize your Website experience, to improve customer service, to process transactions, to administer a contest, promotion, survey or other site feature, and to send periodic emails.

We may also use personal information for internal purposes such as auditing, data analysis, processing payments and orders, and research to improve our products, Services, and customer communications. If you enter into a sweepstake, contest, or similar promotion, or access linked social media accounts, we may collect and use the information you provide to administer those programs. In addition, information that you give us may be combined with other personal information (e.g., order history, demographic data, etc.) from third-party sources to improve our products, Services, and programs. For example, we may receive updated delivery and address information from third-party sources, which we use to correct our records and ensure delivery of TrailPeak products and materials to you.

Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company, other than for the purpose of delivering the purchased product or Service requested and as otherwise noted in this Privacy Policy or the Terms of Use.

You may opt-out of receiving future mailings by following the steps described in the section below entitled “Removing, Correcting or Changing Your Information”.

We may also collect personal and non-personal information through the use of “cookies” and other technologies such as pixel tags and web beacons. A cookie is a file that is added to your computer so that the Websites can function smoothly, for example, to retain the contents in your shopping cart. Cookies help us to better understand our customer’s use of the Websites and preferences, tell us which parts of our Websites our customers have visited and the frequency and length of such visits, help us improve the appearance and functionality of the Websites, and measure and facilitate our understanding of the effectiveness of advertisements and web searches. When non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy. Cookies may remain on your computer after you log off the Websites. If you wish to disable cookies, or be notified before they are placed, you may do this by modifying your Web browser settings, however, if you do so, you may not be able to access or use certain features of the Websites.

This information may include your Internet Protocol (“IP”) address (which is the number automatically assigned to your computer whenever you access the Internet), browser type and language, Internet service provider (“ISP”), referring and exit pages, operating system, date and time stamp, and other data. The IP address does not identify your name, email address, or other personal information. We may also collect information, such as your occupation, language, zip code, area code, unique device identifier, location, and the time zone where our products are used so that we can better understand customer behavior and improve our products and advertising. We also may collect information about how you use our Websites and Services from our other products. For example, some e-mail communications you may receive from TrailPeak Websites, Apps, and/or Services may include a clickable URL, which will automatically direct you to the Websites and collect non-personal information in the process.

Sharing Personal Information with Third Parties

We may disclose your personal information to trusted third parties for business purposes and as otherwise described in this Privacy Policy. When we disclose personal information for a business purpose with Service Providers as described below, we usually enter into agreements with those third parties that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. We share your personal information with the following categories of third parties:

Service Providers: TrailPeak shares personal information with companies and individuals who provide certain services for TrailPeak, such as information and payment processing, extending credit, fulfilling customer orders, delivering products, managing, analyzing, and enhancing customer data, marketing consultation, research, assistance, and/or sponsorship, providing customer service, website maintenance and operation, assessing your interest in our products and Services, and conducting customer research or satisfaction surveys, etc. These companies have access to personal information, including financial information, needed to perform their services or functions, are obligated to protect your information, and may be located wherever TrailPeak elects.

Partners: TrailPeak may share your email and contact information with third parties who co-sponsor events with TrailPeak, and/or who collaborate with TrailPeak in various activities, including marketing, promotional, and other activities. Occasionally, TrailPeak may send information from our affiliates or partners to our customers that we think they may find interesting, in addition to communications directly from TrailPeak.

Lawful Requests: TrailPeak may release your personal information: if it receives a lawful request through legal or administrative process, litigation, and/or from public or governmental authorities in or outside of your country of residence; to enforce or apply our Terms and other agreements; or to protect the rights, property, or safety of TrailPeak, our customers, our employees, and/or others. TrailPeak may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate.

Business Transfers: In the future, TrailPeak may sell or buy companies, subsidiaries, business units, etc., and transfer or receive customer personal information as a result. Such personal information remains subject to the provisions made in any pre-existing privacy policy, unless modified or the customer consents otherwise. In the unlikely event that TrailPeak or substantially all of its assets are acquired, customer personal and non-personal information will be one of the transferred assets and will be subject to the terms of this Privacy Policy as it may be amended in the future.

Your Consent: TrailPeak may disclose and use your personal information any time that you consent to such disclosure or use.

Third Party Analytics and Vendors: Our website also uses third-party analytics and vendors such as Google, including Google Analytics and Google Ads, Facebook, Instagram, Twitter, Vimeo, and similar services.

TrailPeak and our third-party vendors or partners may use analytics data for a variety of purposes such as to improve the design and content of our Websites, to help us learn things like what pages are most attractive to all of our visitors and what promotions visitors like to see, and to gauge the success of our advertising campaigns.

Interest-Based Advertising: We may work with third-party advertising companies that collect and use information about your online activities across sites over time, in order to deliver more relevant advertising when you are using the Websites, App, and/or Services. This practice is known as interest-based advertising. You may visit www.aboutads.info to learn more and to opt out of this type of advertising by companies participating in the Digital Advertising Alliance self-regulatory program. We do not operate or control these sites and are not responsible for the opt out choices available there. Note that electing to opt out will not stop advertising from appearing in your browser or applications, although it may make the ads you see less relevant to your interests. If you delete, block or otherwise restrict cookies or use a different computer or Internet browser, you may need to renew your opt-out choice. Our Websites currently do not have a mechanism to recognize “Do Not Track” signals.

Removing, Correcting or Changing Your Information

As a registered user, our Websites provide you with the choice to receive or decline most TrailPeak communications. Except as otherwise provided herein, to elect not to receive future electronic communications from TrailPeak and not have your information shared with other companies, or to correct or change certain information that you have previously provided:

  1. You may log on to www.trail-peak.com as a registered user, access your account information, and change your preferences.
  2. You may contact us through the information provided on our website.
  3. You may follow the “unsubscribe” instructions in any commercial email you receive from us.

Information Security

TrailPeak is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we store the personal information you provide on computer systems with limited access that are located in controlled facilities. When we transmit highly confidential information (such as a credit card number) over the internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Retention of Personal Information

We will retain your personal information for as long as needed to provide you Services, to fulfill the purposes for which we collected it, and to comply with our legal obligations, resolve disputes, and enforce our agreements. We may also retain your information for statistical purposes, research, and future marketing.

Children’s Privacy

Our Websites and Services are not directed to children under the age of 16. We do not knowingly collect personal information from children under 16. If you are a parent or guardian and you believe your child has provided us with personal information, please contact us. If we become aware that we have collected personal information from a child under 16 without verification of parental consent, we will take steps to remove that information from our servers.

Our Websites may contain links to other websites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information.

Changes to this Privacy Policy

TrailPeak may update this Privacy Policy from time to time. When we do, we will revise the “last modified” date at the top of this Privacy Policy. We encourage you to periodically review this page for the latest information on our privacy practices. Your continued use of the Websites, App, and/or Services after any changes or revisions to this Privacy Policy constitutes your acceptance of such changes.

Additional Privacy Rights for California Residents

If you are a California resident, the California Consumer Privacy Act (“CCPA”) provides you with specific rights regarding your personal information. This section describes your CCPA rights and explains how to exercise those rights.

Right to Know and Data Portability: You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you: (1) The categories of personal information we collected about you; (2) The categories of sources for the personal information we collected about you; (3) Our business or commercial purpose for collecting or selling that personal information; (4) The categories of third parties with whom we share that personal information; (5) The specific pieces of personal information we collected about you (also called a data portability request); and (6) If we sold or disclosed your personal information for a business purpose, two separate lists disclosing: sales, identifying the personal information categories that each category of recipient purchased; and disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

Right to Opt-Out of Sale of Personal Information: We do not sell your personal information in exchange for monetary compensation. However, like many companies, we may use services that help deliver interest-based ads to you. Our use of some of these services may, under CCPA, be considered a “sale” of your information because they involve transferring personal information (such as cookie identifiers and IP addresses) to third-party advertising companies. You have the right to opt-out of this disclosure of your information. Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not: deny you goods or services; charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; provide you a different level or quality of goods or services; or suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Exercising Your Rights: To exercise the rights described above, please submit a verifiable consumer request to us by contacting us through the information provided on our website. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must: (1) Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and (2) Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format: We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
